      "SLAPPs,"or Strategic Lawsuits Against Public Participation, are lawsuits flied against people or organizations for exercising their  First. Amendment right to freespeech or to petition the government, rights granted by the United States and California constitutions. Yet, every year, thousands of individuals, community groups, and organizations are sued for exercising these constitutional rights.

       

       This panel discussion will include:  the  background and  history of the anti-SLAPP law (CCP §425.16), ethical issues, the two prongs of an anti-SLAPP motion, the scope of its protection for petition  and  speech  activity, exceptions to the anti-SLAPP law, the  plaintiffs probability of prevailing, discovery, anti-SLAPP hearings, appeals, motions for attorneys' fees, collection of fee awards, SLAPP back suits and motions  under CCP§425.18,and efforts  to enact a federal anti­ SLAPP law.

       

       CASP is proud to have led the fight for passage, preservation, and strengthening of the California anti-SLAPP law for the last 20 years CASP has been practicing in this area since its passage.
